Terms and Conditions
These Terms and Conditions constitute a legally binding document that governs the relationship between Travel and Trip LLC and any legal or natural person who uses the Platform as a User.
Registration and commencement of use of the Platform in any form confirms the User's full and unconditional consent to these Terms and Conditions.
1. Definitions
The terms used in these Terms and Conditions shall have the following meanings:
"Travel and Trip" means Travel and Trip LLC, identification number: 438738877, legal address: Samtredia Municipality, Village Dabla Gomi, 3rd Street, N3, Georgia.
"Platform" means the website https://mywaygeo.com/, the sole and lawful owner of which is Travel and Trip.
"Seller" means a trader within the meaning of the Law of Georgia "On the Protection of Consumer Rights." A legal or natural person that sells services through the Platform. Information about the Seller (name, address, phone number, and email address) is available on the web page.
"User" means any person who uses the Platform, including Platform visitors, natural persons who place orders, and receive services.
"Intermediary" means a service provider within the meaning of the Law of Georgia "On Electronic Commerce."
"Agreement" means these Terms and Conditions, on the basis of which the User makes purchases on the Platform.
2. General Provisions
The Platform is an online trading space through which an economic operator (the Seller) is given the opportunity to offer and sell tourist and transfer services, and Users may purchase said services throughout Georgia.
The page contains information about the Seller, specifically: name, legal address, registration number, phone number, and email. Also, any additional terms set by the Seller (if applicable).
Travel and Trip is obligated to ensure the accuracy of the information published on the Platform about the Seller and to update it as necessary, to the extent that such information is provided to Travel and Trip by the Seller.
In order for the User to be able to communicate directly, promptly, and effectively with the Seller regarding order placement, service provision, or refund matters in case of order cancellation, the order page integrates a special communication channel (so-called chat), which enables written communication between the User and the Seller within the Platform.
Through the official website mywaygeo.com, Travel and Trip LLC acts as the direct service provider and a party to the agreement.
Travel and Trip LLC is responsible for any damage caused by technical or functional malfunction of the Platform resulting in a violation of the rights of the User or service recipient, as provided by the Laws of Georgia "On the Protection of Consumer Rights" and "On Electronic Commerce."
3. User Account
To fully utilize Travel and Trip's services, it is necessary to create an account (profile). To open an account, the User must follow the instructions on the Platform: provide the required information and, if necessary, undergo verification.
Before creating an account, the User must ensure that doing so does not violate the legislation of Georgia or the rights of third parties.
The User bears full responsibility for the accuracy of the data provided during account creation.
The purchase of certain products on the Platform is permitted only by adults. Accordingly, parental or guardian involvement may be required for placing certain orders if the User is a minor.
Travel and Trip reserves the right to additionally request the User to confirm the accuracy of the data provided on the Platform. The User's data will be processed in accordance with Travel and Trip's Privacy Policy and applicable legislation.
On Travel and Trip's official website, Users have the option to register and create an account using Google. In such cases, the User must additionally agree to Google's terms and conditions, compliance with which is the User's responsibility.
The User is responsible for the secure storage of account details. If the User suspects that a third party has access to their account details, the User is obligated to immediately change them or contact Travel and Trip.
The User is responsible for all actions carried out through their account, regardless of whether the User performed those actions personally.
Travel and Trip is authorized, for technical and/or security purposes, including in the event of detecting fraudulent or suspicious activity and/or a gross violation of Georgian legislation or these Terms, to temporarily or permanently block/delete an account.
4. Orders
Placing orders on the Platform is available only to registered Users. To place an order, the User must follow the instructions on the Platform and fill in the required fields.
Before finalizing the order, the User is given the opportunity to review the order details and make changes as necessary, including correcting any errors, if applicable.
Immediately upon the User's electronic submission of the order, the User receives confirmation of order receipt through the Platform or the relevant communication channel (email or electronic notification).
After receiving the order, the Seller processes it. In cases where the order cannot be accepted due to the unavailability of drivers or other objective circumstances, the Seller is authorized to cancel the order. The Seller may cancel the order within 15 (fifteen) minutes of its receipt. In the event of order cancellation, the User is immediately notified through the Platform or other communication means.
Travel and Trip reserves the right to cancel an order in cases where there are objective grounds for cancellation, including the detection of fraudulent or suspicious operations, software or technical defects, data errors, or other similar circumstances.
The User has the right to cancel the order without incurring any liability no later than 24 (twenty-four) hours before the time of service provision. In the event of cancellation within this timeframe, the service fee paid by the User will be fully refunded. In the event of cancellation after this deadline, the fee will not be refunded.
5. Payment Methods
Payment for orders on the Platform can be made through the following methods:
• Bank cards issued by banks operating in Georgia;
• Via Wise;
• Via PayPal.
6. Currency
When purchasing services through Travel and Trip's official website, payments are made in Georgian Lari, US Dollar, and Euro.
7. Service-Related Guarantees
Travel and Trip LLC undertakes the obligation to provide services to the User in accordance with the legislation of Georgia. Services include transit and tourist transfers.
In the event that the service provided is defective or has not been performed, or has been performed in violation of the service delivery deadline, the User must set a reasonable additional period for Travel and Trip to perform the service/remedy the defect, except where this is impossible due to the nature of the service or would require disproportionate or unreasonably high costs, as provided by law.
In the event that the additional period expires without result, the User has the right to:
• Request an adequate reduction in the service price (if the service price is determined);
• Withdraw from the agreement and demand compensation for damages in accordance with the procedure established by Georgian legislation.
Setting an additional period is not mandatory if it is evident that it would yield no result, or if the User made the timely receipt of the service a condition of the agreement.
8. Intellectual Property Rights
The User shall not perform any action that infringes on the intellectual property rights held by the Platform or any third party. Any reproduction, publication, distribution or redistribution of Platform content, in whole or in part, by any means (including caching, creation), sale, resale, retransmission, or provision to third parties is prohibited.
In the event that any material may be downloaded or printed as part of the service, such material may only be downloaded to a single device (and may be printed in written form) and used solely for personal, non-commercial purposes.
9. Limitation of Platform Liability
Travel and Trip does not guarantee that the Platform will be permanently available and/or will always function without interruption; however, it is liable for any damage caused by Platform malfunction that violates the User's rights as provided by the Laws of Georgia "On the Protection of Consumer Rights" and "On Electronic Commerce."
10. Disputes/Legislation
The relationship between the User and Travel and Trip is governed by the legislation of Georgia.
In the event of a claim, the User is authorized to contact Travel and Trip in writing at the following address: info@mywaygeo.com or Samtredia Municipality, Village Dabla Gomi, 3rd Street, N3. Travel and Trip LLC will review the claim and respond to the User within no more than 14 (fourteen) calendar days from the date of receipt.
Any dispute shall be resolved through negotiation. In the event that negotiation is unsuccessful, the User is authorized to contact the LEPL – Competition and Consumer Protection Agency of Georgia (considering the nature of the dispute) or the court directly.
11. Amendments/Additions
This document may be amended unilaterally, at the initiative of Travel and Trip, at any time. Registered Users shall be notified of such changes within a reasonable period in advance, in the form of a mandatory notification in their personal account, by email, or by SMS.
